Waiver and Release of Liability Agreement

1. Agreement to Terms
   By signing this Waiver and Release of Liability Agreement, I confirm that I have read, understood, and voluntarily agree to the terms outlined below as a condition of my participation in a guided tour at Palm Garden Nevis Limited (“Company”).
2. Assumption of Risk
   I acknowledge that participation in a tour at Palm Garden Nevis Limited involves inherent risks, including but not limited to:
   • Uneven terrain, slippery surfaces, and natural obstacles
   • Exposure to plants, insects, and wildlife
   • Changing weather conditions, sun exposure, and dehydration
   • Potential allergic reactions to plants or insect bites
   • Falling branches or debris
   I voluntarily assume all such risks, whether known or unknown, and accept full responsibility for my participation.
3. Release of Liability
   On behalf of myself, my heirs, assigns, and legal representatives, I release, discharge, and hold harmless Palm Garden Nevis Limited, its owners, employees, agents, and affiliates from any claims, liabilities, damages, or losses arising from my participation in the tour, including but not limited to personal injury, property damage, or death, whether caused by negligence or otherwise.
4. Indemnification
   I agree to indemnify and hold Palm Garden Nevis Limited harmless from any claims, lawsuits, or damages (including legal fees) resulting from my participation in the tour, including injuries or damages to third parties caused by my actions.
5. Health and Fitness Declaration
   I certify that I am in good health and have no medical conditions that would make participation unsafe for myself or others. I assume full responsibility for my medical needs, including carrying necessary medications for allergies or other conditions.
6. Emergency Medical Authorization
   In the event of a medical emergency, I authorize Palm Garden Nevis Limited and its representatives to seek medical assistance on my behalf. I acknowledge that I am responsible for any medical expenses incurred.
7. Photography and Media Release (Optional)
   I grant Palm Garden Nevis Limited permission to use any photographs or videos taken of me during the tour for promotional purposes without compensation.

8. Code of Conduct
   I agree to follow all safety instructions provided by the tour guide and adhere to the following rules:
   • Stay on designated paths and refrain from picking or damaging plants.
   • Respect wildlife—do not feed or touch animals.
   • Dispose of trash properly to preserve the natural environment.
   • Avoid disruptive or unsafe behavior.
   Failure to comply may result in removal from the tour without refund.
9. Cancellation and Refund Policy
   I acknowledge that tours may be rescheduled or canceled due to unforeseen circumstances, including inclement weather or safety concerns. Refunds or rescheduling will be handled in accordance with the company’s policy.
10. Minor Participation (If Applicable)
    If signing on behalf of a minor, I confirm that I am the parent or legal guardian and assume full responsibility for the minor’s participation.
11. Governing Law
    This agreement is governed by the laws of St. Christopher & Nevis. Any disputes shall be resolved in the applicable courts of Nevis.

Acknowledgment and Signature
I HAVE READ THIS AGREEMENT CAREFULLY, UNDERSTAND ITS CONTENTS, AND VOLUNTARILY AGREE TO ITS TERMS. I AM AWARE THAT BY SIGNING THIS DOCUMENT, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
